It hadn’t occurred to me yet that if he gets probation, he will have a probation officer. Honestly, I can’t imagine he cooperates with that process. Like he might show up for the interview, but he’s not going to be contrite or apologize for his conspicuous contempt for the court. He won’t comply with requirements to clear travel plans or list his associates.

Jail time might be even better for his campaign than probation. At least the eyes of the world will be on him in prison, and he can make speeches and send letters via surrogates for the campaign. The press will be writing ligistical stories for weeks, how does he campaign, how does he fundraise, which Aryan gang will he join, where do the secret service agents sleep.

Being on probation, he’ll be under scrutiny and could just as likely end up violating and end up in jail for non-compliance anyway. Every story will be about how this statement or that rally might have been a violation.

I could be wrong, but I think drug tests on probation are at the discretion of the probation officer. There are stories about pills in the White House, but the probation officer might not feel that drug tests are warranted.

On the other hand, he does have to submit to drug testing if requested. He also must cooperate with law enforcement.

He’ll be under all kinds of scrutiny that he’s never had to endure before. As is, the odds that Merchand will jail him are decidedly non-zero. The odds of him fully complying with release conditions are quite low.
