TransplantedSconie, to politics in Trump gag order partially lifted in hush money case ahead of first presidential debate

Blows my mind how much they bend over for this scumbag.

dhork,

But I recall reading that the DAs office was in favor of a partial lifting of the order. There is no reason to keep the order in place for witnesses, for example.

Trump’s lawyers wanted a full cancellation of the order and as far as I can tell the DA’s side got everything it asked for and Trump’s side only got the things the DA agreed to.

ccunning,

There is no reason to keep the order in place for witnesses, for example.

I’d argue there is plenty of reason to keep it in place for witnesses until all appeals have played out…

dhork,

As I understand it, though, the point of the gag order was to prevent the witnesses from being intimidated before their testimony. The trial is over, and there will be no more testimony. So a gag order on them is no longer necessary to protect the integrity of the trial process.

ccunning,

The trial is over, and there will be no more testimony

I see - I assumed wrongly they would need to testify again in a retrial if an appeal was won.

Wasn’t there also talk of declaring a mistrial at some point? Would they testify again in that case?

Nougat,

Not only that - he's got many other criminal counts still pending. The potential witnesses to those crimes are paying close attention to how much protection these witnesses get in the wake of their testimony.

Lift this gag order, Trump goes on a rampage, witnesses get an increased level of threats or, god forbid, actual violence - that is a chilling effect on witnesses in all of Trump's other cases, and to a lesser extent, for witnesses in any future cases involving any defendant.

dhork,

It’s not this judge’s job to police those cases, though. The other judges can apply whatever orders they need in order to protect the integrity of the trials they oversee. But this trial is over.

Nougat,

Like Judge Cannon, right?

dhork,

Judge Cannon has the ability to protect her case through orders like this. But it seems all she wants to do is protect her little Donnie-kins from that meanie Jack Smith…

Zorsith,
@Zorsith@lemmy.blahaj.zone avatar

Not to mention retaliation; I would fear for my life if I was a witness and my name was made public for this case, ever.

Ensign_Crab,

Not only that, it sends a message to witnesses in ongoing cases that they will never be safe.

Viking_Hippie,

a gag order on them is no longer necessary to protect the integrity of the trial process.

But still necessary to minimize the risk of his crazed cult following violently targeting the witnesses he continues to demonize.

Upholding that protection is ESPECIALLY important when it comes to a widely viewed event such as a presidential debate.

xmunk,

The fear (a rational fear, I think) is that if they didn’t, they’d potentially have an armed rebellion to deal with. Yea, it’s shitty for this asshat to get gift after fucking gift but if there was any appearance of him being targeted he’d never fucking shut up about it.

I’m done with their bullshit and I feel, for democracy’s sake, we should just seize all the family assets to discourage future ass hattery and deal with the consequences now… but I also do appreciate my relatives not living in a war zone.

themeatbridge,

If the rule of law leads terrorists to attack institutions, then we need to stop those terrorists with force. We should not bend over backwards to avoid angering the terrorists.

xmunk,

I think you’re being too black and white. The purpose of all this society shit isn’t to have laws that are justly applied - it’s to (ideally, late stage capitalism is fucking is here) provide the best life we can to as many people as we can. Being murdered, robbed or a bundle of other things fucking sucks so we use the law to guarantee (again, suckinh at this right now) safety and stability.

If someone did a little asshattery I don’t want to start a civil war - as a parallel, if someone runs a red light and we could either let them go unpunished or start a high speed chase, I’m going to favor the former. There is a line somewhere, there is some amount of petty treason someone could commit and some quantity of armed fanatics backing them where I’d say “we should just not risk it.”

Basically, sometimes it’s optimal to be non-confrontational even if it feels shitty.

themeatbridge,

Nah, fuck that noise. I don’t want to start a civil war, either, but I’ll be more than happy to end one. You’re conceding ground to effective terrorism.

just_another_person,

Well, I mean…they’ve committed fraud at this point by submitting a false bond to the court. I don’t see how they could stall at all.

FlowVoid,

they’ve committed fraud at this point

Not quite. At this point Letitia James is arguing that the bond is no good, but a judge hasn’t yet ruled on whether she is right.

If and when that happens, there will be less room to stall.

Evilcoleslaw,

It’s court. A week or two is not a long time.

FlowVoid,

Letitia James challenged the validity of the bond roughly two weeks ago.

The challenge does not harm Trump’s bond but makes it so that the insurance company will need to show proof that they can pay it.

Trump’s lawyers responded last week.

Now she is preparing to argue before a judge that their response is inadequate.

The hearing will be on Monday.

JeeBaiChow,

Is he reauired to attend this one as well?

FlowVoid,

No, he is only required to attend criminal trials.

The appeal bond is part of a civil case, not criminal. And appeals are not trials, so attendance is not required.

FuglyDuck, to politics in Chubb ended Trump fraud bond talks after backing E. Jean Carroll appeal bond, court filing says
@FuglyDuck@lemmy.world avatar

I’m going to assume they had somebody go out to the properties he tried to put up as collateral for the bonds and they assessed a much lower value than what trump is insisting it’s worth. In short his properties aren’t worth enough to cover it.

Riccosuave, (edited )
@Riccosuave@lemmy.world avatar

I’m assuming they also required financials for these properties that show any mortgages or liens that are already attached to them. There is no way they would accept collateral that already has liabilities against them because they would not be able to seize them outright, and if a sale was forced that caused the property to sell for way below market value they might not recoup their funds. I see no way that any major financial institution is going to risk a half a billion dollars on Trump’s behalf without a 100% guaranteed return on investment.

FuglyDuck, (edited )
@FuglyDuck@lemmy.world avatar

That too.

Also, “it’s just business”… seems kind of reasonable now.

Though I wouldn’t want trumps left over properties. You’ll never get the greasy shit stains out. Or the smell.

Edit: it occurs to me that one strategy rich fucks use for “earning” a living and avoiding cap gains taxes is taking loans using their assets as collateral- with real estate, taking extra mortgages out and using their rent income to pay interest.

So chances are solid most of, if not all of his properties are leveraged.

Now those salmon fishermen (who didn’t even have to pay the $700 fee to monitor their amount they catch that this lawsuit was about) can decimate their fishing spot and subject all of us to unsafe workplaces, dumping of chemicals into water supplies and pollution of the air we breathe.

alilbee,

This is so far beyond salmon fishing. This is going to weaken every executive agency we have severely. Congress is broken and they’re never going to give piecemeal explicit authority to these agencies for comprehensive work. The EPA, the FTC, the FCC, the SEC, the ATF. They’re all damaged and weakened by today’s ruling and thus so is our environment, our economy, our utilities, and our regulations. This was the conservative wet dream ruling above almost any other this session. This was the Dobbs-style meat thrown to the educated, more lawful evil Republicans.

Please vote, so we can nominate justices to the Supreme Court. Please help us add another Sotomayor or Jackson instead of an Alito, Thomas, or at this rate, Cannon. Not feeling hopeful right now, but I have to ask.

Know_not_Scotty_does,

Every election for the rest of our lives is the most important election of our lives. Don’t ever forget what has been done. Vote like your life and the world depend on it because frankly, they do. If you want another generation to grow up even close to the same quality of life we’ve had, it is critical to recognize that one party has been actively rolling back protective legislation over and over again against the better interest of the people of thos country and the world. What if we tried using a voting system that wasn’t first past the post voting? That way, more then 2 political parties would be viable and there would be no spoiler effect.

Imagine several other people on that debate stage. Then it wouldn’t be such a knife in the gut to see a poor performance coming from Joe biden. There would be other people to back. Other people to compete for the office. Other people to not let trump get away with his bullshit.

How we vote is controlled at the state level, we dont need to wait for federal reform! In fact some states have already passed electoral reform.

Everyone here wants ranked choice. It’s just not simple to pass. I do highly recommend that those who are able should push for a ballot initiative in their state and/or campaign for the issue. Do you have any links or resources for those who might be looking to get engaged further in those state-level efforts?

Well, I don’t know how "respectful” he was, but he did show acts of contrition. And he certainly did behave himself in court as a witness.

disguy_ovahea,

That’s incorrect. The charges were different, and a few of Cohen’s were more severe (higher class felonies).

Cohen pleaded guilty to 5 counts of tax evasion, one count of making false statements to a federally insured bank, one count of causing an unlawful corporate contribution, and one count of making an excessive campaign contribution.

justice.gov/…/michael-cohen-pleads-guilty-manhatt…

Trump was convicted of 34 counts of falsifying business records.

elliot_crane,

From the article:

The probation interview is required by the court as part of the former president’s pre-sentencing report.

@treefrog also had a good quote from the article providing more info as well.

The name “probation interview” is a poor one. Sentencing hasn’t happened yet and this interview is standard operating procedure to collect relevant information about the convicted party so that the judge can make an informed decision during sentencing.

(43:33) So I said, “Let me ask you a question.”

(43:35) And he said, “Nobody ever asked this question, and it must be because of MIT, my relationship to MIT,” very smart.

(43:43) I say, “What would happen if the boat sank from its weight and you’re in the boat and you have this tremendously powerful battery and the battery’s underwater, and there’s a shark that’s approximately 10 yards over there?”

(43:58) By the way, a lot of shark attacks lately. Do you notice that? A lot of shark… I watched some guys justifying it today. “Well, they weren’t really that angry. They bit off the young lady’s leg because of the fact that they were not hungry, but they misunderstood who she was.” These people are crazy.

(44:14) He said, “There’s no problem with sharks. They just didn’t really understand a young woman swimming now who really got decimated and other people too,” a lot of shark attacks.

(44:22) So I said, “So there’s a shark 10 yards away from the boat, 10 yards or here. Do I get electrocuted if the boat is sinking, and water goes over the battery, the boat is sinking. Do I stay on top of the boat and get electrocuted or do I jump over by the shark and not get electrocuted?” Because I will tell you he didn’t know the answer.

(44:42) He said, “Nobody’s ever asked me that question.”

(44:45) I said, “I think it’s a good question. I think there’s a lot of electric current coming through that water.” But you know what I’d do if there was a shark or you get electrocuted, I’ll take electrocution every single time. I’m not getting near the shark.
